Terms & Conditions
By clicking Profile Type to join as “Employer”, “Jon Seeker”, “Sign Up” or similarly registering, accessing or using Pluckhired Ltd’s services or software you are entering a legally binding contract. If you wish to terminate this contract at any time you can terminate your account by contact team@pluckhired.com.
General
The Terms and Conditions (“Terms”) apply to all unregistered users, users registering accounts, and visitors and anyone accessing, using or otherwise acknowledging acceptance of these Terms. These Terms apply to Pluckhired Ltd’s services, software including but not limited to the email, website and mobile application (“Pluckhired”). Registered users of Pluckhired are signed on as Job Seekers or Employers.
Pluckhired, Ltd., (“pluckhired”) is a company registered in the State of Delaware.
You acknowledge that you have carefully read these Terms and accept these Terms each time you use or access Pluckhired. These Terms also include our Privacy Policy. Where Pluckhired has requested your consent to the Terms by way of a ‘check the box’, ‘click-through’, or other ‘I agree’ feature, you confirm that you have carefully read it and agree to it.
The terms “we” and “us” refer to Pluckhired. The term “you” or “your” refers to the person, firm, company or organization using or accessing Pluckhired.
Use of Pluckhired
To use Pluckhired you agree that you are at least 18 years old or the minimum age to use Pluckhired in your jurisdiction and that you will only register one account in your legal name. Accounts created with false information is a violation of the Terms this includes accounts registered for individuals under the age of 18. If the law requires that you must be older than 18 years to use Pluckhired without parental consent (including the use of personal data) then you cannot use Pluckhired until you reach that age.
You agree not to create or use an account for anyone other than yourself.
You represent and warrant that you will only use Pluckhired for lawful purposes and in a manner consistent with these Terms, the intended purpose of Pluckhired, all applicable laws and regulations and Pluckhired policies. You may not use Pluckhired for any unlawful purposes including but not limited to any use that is discriminatory, obscene, offensive, defamatory or otherwise illegal or objectionable, unlawful or in breach of any application laws, regulations, copyrights, trademarks or intellectual property rights.
You are prohibited from accessing, altering or deleting any information on Pluckhired that you do not have authority to access, from taking any action or use any device or software to crash, damage or interfere with the operation of Pluckhired or make any attempt to disassemble or modify any of the software, coding or information on Pluckhired.
You are solely responsible for any and all information submitted and by you to Pluckhired or posted on your account. You are responsible for ensuring that all information provided by you is accurate, truthful and kept up to date.
You may only access or use Pluckhired under your true identity, contact coordinates and legal name and all truthful data, including, personally identifiable information.
You are responsible for ensuring that all information, data and files including video files are free of viruses that may damage or interfere with any system or data prior to submitting to Pluckhired.
We reserve the right to remove any information supplied by you from Pluckhired at any time for any reason in our sole discretion.
You agree not to act in a manner or post any content on Pluckhired including in your video that is harassing, threatening, abusive, racist or bigoted, is otherwise objectionable (as determined by Pluckhired).
You agree that by using Pluckhired you may see content or information that might be inaccurate, incomplete, misleading, offensive or otherwise harmful. Pluckhired generally does not review content provided by users or others. You agree that Pluckhired is not responsible for content or information on Pluckhired and cannot always prevent misuse. You agree that Pluckhired has the authority to review all content and information provided by you.
Pluckhired is intended to assist Employer to find Job Seekers for employment opportunities. Pluckhired is not responsible for any employment offering, job offer, or any outcome that may occur between a Job Seeker and an Employer.
Pluckhired provides Employers with the opportunity to find Job Seekers from a talent pool. Pluckhired does not endorse, supervise, monitor or otherwise engage with Employers or Job Seekers in joining Pluckhired or selecting Job Seekers for job openings.
Pluckhired does not guarantee the identity of an Employer, Job Seeker or any user and cautions Employers and Job Seekers to confirm the validity of information on Pluckhired. Job Seekers are encouraged to confirm the validity of a job opening and job offer before taking an adverse action regarding their current employment. You are solely responsible for verifying the accuracy of information on Pluckhired.
Pluckhired has no liability or obligation to a Job Seeker, Employer or any user of Pluckhired for any injury or harm that may arise out of the use of Pluckhired.
Pluckhired does not in any way screen or approve any Job Seeker or Employer or verify any information submitted by a Job Seeker, Employer or other user of Pluckhired.
Pluckhired assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any information or content on Pluckhired including any information about a Job Seeker or employer.
Pluckhired is not and shall not be a party to any disputes between you and any other user of Pluckhired including but not limited to any disputes between a Job Seeker and an Employer.
Pluckhired does not guarantee that a Job Seeker’s current or any previous employers will not see a Job Seeker’s profile on Pluckhired and has no liability for any adverse action taken by any employer on a current employee or ex-employee because the employee is a Job Seeker on Pluckhired.
You agree to comply with all applicable laws, regulations and laws as well as all policies and procedures established by Pluckhired.
You agree that you are solely responsible for all of your acts or omissions. Any misuse of Pluckhired, including, but not limited to communications, in violation of these Terms is prohibited. You can report such team@pluckhired.com.Pluckhired Account
To become a registered user of Pluckhired individuals will join Pluckhired as a Job Seeker or an Employer. Once registered the individual will have a Pluckhired account. Individuals who register as a Job Seeker will enter a talent pool that is searchable by Employers. Individual’s registering as an Employer will have access to the talent pool via a password account. Employer’s will be required to provide information regarding the employer’s business including name and address that if necessary, can be verified by Pluckhired.
To create an account with Pluckhired you will be required to provide a valid email where Pluckhired can correspond with you. Accounts maybe deleted or disabled if the email you submit is not valid.
Passwords
Employers registering on Pluckhired will receive a password. You are responsible for the security and proper use of your password. Your password should be kept confidential. You agree to notify us immediately if you suspect any unauthorized use of your account or access to your password. Pluckhired accepts no liability for any unauthorized or improper use or disclosure of any password. Passwords are subject to cancellation or suspension by Pluckhired at any time.
Profile
When you register and set up an account with Pluckhired, as a Job Seeker or Employer you will be required to create a profile for you that will include personal information you provide (“Profile”). By registering with Pluckhired you are permitting Pluckhired to share all information in your Profile. Pluckhired has no liability for the disclosure of personal information you provide in your Profile or on Pluckhired.
Job Seeker Information
As a Job Seeker, you understand and agree that by registering with Pluckhired Employers searching for Job Seekers will have access to the personal information including your name, address, telephone (mobile) number, video and voice images of you that you submitted to Pluckhired and you agree by registering with Pluckhired that Employers may view all such personal and other information and use such information to contact you directly.
Pluckhired is under no obligation to publish any information or content and can remove any such content with or without notice.
Job Seekers are required to submit a video recording to Pluckhired in order to complete user registration. You understand that by submitting the video recording other users of Pluckhired including Employers will have access to the information and images on the video. You agree to submit a video in compliance with Pluckhired polices and Terms. Videos are required in order to complete your user registration. You can delete your video at any time by contacting team@pluckhired.com.
Email, Messages and Notices
You agree that Pluckhired can provide you with email, messages and notices within the Pluckhired and via direct contact information you provide to Pluckhired including email, telephone, mobile phone and physical address.
Your License
You own the content and information you submit to Pluckhired and you are only granting Pluckhired an unrestricted, irrevocable, perpetual, non-exclusive, fully-paid and royalty-free, license (with the right to sublicense) to use, copy, perform, display, create derivative works of, adapt and distribute such content in any and all media (now known or later developed) throughout the world.
You agree that this license includes the right for us to provide, promote, and improve Pluckhired and to make content submitted to or through Pluckhired available to other companies, organizations or individuals.
You should only submit content to Pluckhired that you are comfortable sharing with others under the terms and conditions of these Terms.
Content Review
While Pluckhired has no obligation to do so, we reserve the right to review and delete any content that we believe, in our sole discretion, violates these Terms or other applicable policies or that we deem, in our sole discretion, is inappropriate. If you see any content on Pluckhired that you believe violates our policies, you may report that to team@pluckhired.com.
While we have no obligation to do so, we reserve the right to investigate and take appropriate action in our sole discretion against you if you violate these Terms, including without limitation: removing content; suspending your rights to use Pluckhired; terminating your account; reporting you to law enforcement, regulatory authorities, or administrative bodies; and taking legal action against you.
You agree not to use any inappropriate content and to report any inappropriate use, content or messages to team@pluckhired.com.
Termination of Account
Pluckhired may restrict, suspend or terminate your registration and use of your account at any time, if you are in breach of the Terms or any applicable law or policies of Pluckhired.
Cancellation of Account
You may request that Pluckhired cancel your account by contacting team@pluckhired.com
Security
Pluckhired endeavors as best as it can to implement commercially reasonable information technology industry security standards, but there are no guarantees of any form that Pluckhired will not be hacked, intruded upon or intercepted. It is your responsibility to be alert to any hacking, intrusion or interception as to your account or data (including, personally identifiable information) and to report such immediately to team@pluckhired.com.
Pluckhired may discontinue Pluckhired for any reason or no reason in its sole determination and upon such discontinuance, we shall have no obligation or liability to you arising therefrom.
Modification of Terms
Pluckhired reserves the right to update, revise or amend the Pluckhired and these Terms, at any time, for any reason or no reason, and any update, revision or amendment shall apply as of the designated date.
It is your responsibility to periodically check Pluckhired, the Terms and any communications from Pluckhired regarding any such updates, revisions or amendments. Your continued use of our Services after we publish or send you a notice of changes to Pluckhired, or the Terms is acknowledged as your consent to the update terms as of their effective date.
Employer Agreement
By registering as an Employer, you agree to the following:
You will register your account with Pluckhired as a representative of an employer that has a job opening and is seeking individuals to fill that position;
You will provide accurate and truthful information to Job Seekers including job openings, terms of employment, name of employer, wages and offer of employment;
You will comply with the applicable laws or regulations of the state and country where the job is to be performed, including laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use and intellectual property;
You will not solicit or accept any payment of any kind to a Job Seeker including but not limited to consideration of employment or job offer;
All communications with a Job Seeker will be for legitimate business purposes as intended under the Terms of Pluckhired including potential employment for a Job Seeker;
You will not discriminate against applicants on the basis of gender, race, religion, sexual orientation, age, disability, or any other ground(s) prohibited by applicable law;
You agree that Pluckhired may, at its sole discretion, terminate, suspend or revoke your access as an employer for any or no reason.
You agree that Pluckhired can use the name of the Employer’s business and logo on PLUCKHIRED.
Intellectual Property Rights
Pluckhired reserves all intellectual property rights in the Services. All Pluckhired trademarks, service marks used in Pluckhired are trademarks or registered trademarks of Pluckhired.
Pluckhired may contain confidential content and/or trade secrets of Pluckhired and Pluckhired reserves all rights to such content.
Other than the limited right to access and use the Services, you are not granted any right or license to the Pluckhired including software, app or services.
In the event you believe that any content, material on PLUCKHIRED infringe your intellectual property rights or you have another legal basis to assert a claim please contact team@pluckhired.com in writing.
Disclaimer and Limited of Liability
We make no representation or warranty about Pluckhired, including any representation that Pluckhired will be uninterrupted or error-free, and provide Pluckhired (including content and information) on an “as is” and “as available” basis. To the fullest extent permitted under applicable law, Pluckhired disclaims any implied or statutory warranty, including any implied warranty of title, accuracy of data, non-infringement, merchantability or fitness for a particular purpose.
We make no warranty that Pluckhired will meet your requirements, be available on an uninterrupted, timely, secure or error-free basis or that the results that may be obtained from the use of Pluckhired will be accurate or reliable.
Exclusion of Liability
To the fullest extent permitted by law, Pluckhired will not be liable to you for any damages for lost profits or lost business opportunities, reputation (e.g., offensive or defamatory statements), loss of data (e.g., downtime or loss, use of, or changes to, your information or content) or any indirect, incidental, consequential, special or punitive damages.
Where permitted by applicable law, you agree that Pluckhired will not be liable to you for any damages arising from or related to your use of Pluckhired for any cause and regardless of the form of action. All damages, at all times, will be limited to the total fees paid or payable by you to Pluckhired for the services, if any, and will at all times be limited to no more than one hundred dollars ($100).
Hold Harmless and Indemnification
You agree to hold harmless and indemnify Pluckhired and its directors, officers, members, managers, employees, representatives and agents from any claims of yours, including any loss, liability, claim, or demand, including reasonable attorneys’ fees and costs, made by any third party due to or otherwise arising from your use of Pluckhired, including due to or arising from your breach of any provision of these Terms.
Termination
These Terms remain in effect while you use Pluckhired and, for registered users, as long as your account remains open. You may cancel your account at any time. We may suspend or terminate your account or your access for any or no reason, without notice to you. We will have no liability whatsoever to you for any termination of your account or related cancellation of your information.
All provisions of these Terms shall survive termination or expiration of these Terms except those provisions granting access to or use of Pluckhired. For the avoidance of doubt, you agree that these Terms apply to your use of Pluckhired and any content posted on Pluckhired at any time prior to the termination or expiration of these Terms.
Choice of Law and Jurisdiction
The use of Pluckhired and any agreements entered into thru Pluckhired are to be governed by and construed in accordance with English law. The courts of England are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of Pluckhired and any agreements entered into thru Pluckhired.
Privacy
The terms of the Privacy Policy apply to the access, storage and use of information including Personal Information and data. Please carefully review and comply with the Privacy Policy. The terms of the Privacy Policy are incorporated in these Terms.
Other
Except as specifically stated in another agreement we have with you, these Terms constitute the entire agreement between you and Pluckhired regarding the use of Pluckhired and these Terms supersede all prior proposals, negotiations, agreements, and understandings concerning the subject matter of these Terms. You represent and warrant that no person has made any promise, representation, or warranty, whether express or implied, not contained herein to induce you to enter into this agreement. Pluckhired’s failure to exercise or enforce any right or provision of the Terms shall not operate as a waiver of such right or provision. If any provision of the Terms is found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties’ intention or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable. The Terms, and any rights or obligations hereunder, are not assignable, transferable or sublicensable by you except with Pluckhired’s prior written consent but may be assigned or transferred by us without restriction. Any attempted assignment by you shall violate these Terms and be void. The section titles in the Terms are for convenience only and have no legal or contractual effect; as used in the Terms, the word “including” means “including but not limited to.”
